Appellants argue the Examiner erred, because the use of the phrase “circuitry for” in claims 60 and 62 does not create a gap between elements in the claims (see Reply Br. 3—5), and “it is not necessary to recite in the claim everything necessary to operate the device.” Reply Br. 6, citing Deering v. Winona, 155 U.S. 286 (1894), and Special Equipment v. Coe, 324 U.S. 370 (1945).

We are persuaded by Appellants’ arguments.

Appellants do not provide any persuasive reasoning or evidence that such an upper surface as depicted in Matsuda that includes tabs is not encompassed by the claim language. For example only, Appellants have not recited that the upper surface is planar and exclusive of any projections/tabs. Cf. Howmedica Osteonics Corp. v. Wright Med. Tech., Inc., 540 F.3d 1337, 1345 (Fed. Cir. 2008) (declining to impute a limitation into a disputed claim term in the absence of a clear requirement in the specification, even where “every disclosure of [the disputed term] in the specification shows [the alleged limitation]”); see also Ventana Med. It appears to us that the Examiner’s determination of equivalence is rooted in the fact that alumina is listed among several optional components in Dupin, some of which also appear in Nedez to be optional, and to be included in similar amounts to those also disclosed in Dupin. Final Act. 8 citing Dupin 3:42—46; see also id. at 4 (noting how Nedez’s composition “also comprises at least one compound selected from clays, silicates, titanium sulfate and ceramic fibers in a total amount of 30% by weight or less.”). This, without more, is an insufficient basis upon which to determine equivalence. See In re Ruff, 256 F.2d 590, 598—9 (CCPA 1958) (explaining how equivalence cannot be demonstrated by mere existence within a Markush group). Moreover, we note that the Examiner’s attempted reliance on Appellants’ Specification to support a showing of equivalence (Final Act. 9-10) is legally impermissible. See In re Ruff 256 F.2d at 598 (“To rely on an equivalence known only to the applicant to establish obviousness is to assume that his disclosure is a part of the prior art. The mere statement of this proposition reveals its fallaciousness.”).

The correct inquiry in giving a claim term its broadest reasonable interpretation in light of the specification is not whether the specification proscribes or precludes some broad reading of the claim term adopted by the examiner. And it is not simply an interpretation that is not inconsistent with the specification. It is an interpretation that corresponds with what and how the inventor describes his invention in the specification.
