However, merely asserting that the change is an obvious design choice is insufficient. See Cutsforth, Inc. v. MotivePower, Inc., 636 Fed. App’x. 575, 578 (Fed. Cir. 2016) (unpublished) (stating that a particular placement of an element is a design choice does not make it obvious; a reason must be offered as to why a skilled artisan would have made the specific design choice).

Whether the standard deviation of height was known to be a result-effective variable is a question of fact. In re Applied Materials, 692 F.3d 1289, 1295—96 (Fed. Cir. 2012). Questions of fact are resolved in patent examination by the preponderance of the evidence of record. E.g., In re Epstein, 32 F.3d 1559, 1564 (Fed. Cir. 1994).

Our reviewing court has held that a “programmed machine is structurally different from a machine without that program.” In re Noll, 545 F.2d 141, 149 (CCPA 1976); see also In re Bernhart, 417 F.2d 1395, 1399—1400 (CCPA 1969) (“[I]f a machine is programmed in a certain new and unobvious way, it is physically different from the machine without that program; its memory elements are differently arranged. The fact that these physical changes are invisible to the eye should not tempt us to conclude that the machine has not been changed.”).

As for argument (a), we agree with the Examiner in that we see little difference between the abstract nature of “supply chain logistics” and “organizing information through mathematical correlations” that Digitech held to be an abstract idea. Return Mail, Inc. v. United States Postal Service, United States, 868 F.3d 1350 (Fed. Cir. 2017) is also applicable.

Digitech Image Tech., LLC v. Electronics for Imaging, Inc., 758 F.3d 1344, 111 USPQ2d 1717 (Fed. Cir. 2014) 2106

In any event, we are not persuaded that the instant claim language is satisfied by a device that is merely “capable of’ performing the claimed function. The Federal Circuit, in the case of Aspex Eyewear, Inc. v. Marchon Eyewear, Inc., 672 F.3d 1335 (Fed. Cir. 2012) drew a distinction between devices that are merely “capable of’ and those that are “configured to,” with the latter requiring a narrower construction. See also Boston Scientific Corp. v. Cordis Corp., 2006 WL 3782840 (N.D. Cal. Dec. 20, 2006) (construing “adapted to,” in light of patent as a whole, to mean “configured to,” not merely “capable of’). Thus, we are not persuaded that the Examiner’s findings of fact are supported by a preponderance of the evidence.
