The correct inquiry in giving a claim term its broadest reasonable interpretation in light of the specification is not whether the specification proscribes or precludes some broad reading of the claim term adopted by the examiner. And it is not simply an interpretation that is not inconsistent with the specification. It is an interpretation that corresponds with what and how the inventor describes his invention in the specification, i.e., an interpretation that is "consistent with the specification." In re Morris, 127 F.3d 1048, 1054 (Fed. A claim can be obvious even where all of the claimed features are not found in specific prior art references, where “there is a showing of a suggestion or motivation to modify the teachings of [the prior art] to the claimed invention.” SIBIA Neurosciences, Inc. v. Cadus Pharm. Corp., 225 F.3d 1349,1356 (Fed. Cir. 2000) (concluding that patent would have been obvious in light of teachings in prior art which provided motivation and suggestion to modify existing techniques to arrive at method in question).

Ormco Corp. v. Align Tech., Inc., 463 F.3d 1299, 1307 (Fed. Cir. 2006).

However, “[e]ven when obviousness is based on a single prior art reference, there must be a showing of a suggestion or motivation to modify the teachings of that reference.” In re Kotzab, 217 F.3d 1365, 1370 (Fed. Cir. 2000).

“The mere fact that the prior art may be modified in the manner suggested by the Examiner does not make the modification obvious unless the prior art suggested the desirability of the modification.” In re Fritch, 972 F.2d 1260, 1266 (Fed. Cir. 1992).

In Enfish, LLC v. Microsoft Corp., 822 F.3d 1327 (Fed. Cir. 2016), for example, the court noted that “[s]oftware can make non abstract improvements to computer technology just as hardware improvements can[.]” Enfish at 1335. The court put the question as being “whether the focus of the claims is on [a] specific asserted improvement in computer capabilities ... or, instead, on a process that qualifies as an ‘abstract idea’ for which computers are invoked merely as a tool.” Id. at 1335—36. In Enfish, the court found that the “plain focus of the claims” there was on “an improvement to computer functionality itself, not on economic or other tasks for which a computer is used in its ordinary capacity.” Id. at 1336.

Although we agree with the Examiner that the disputed limitation is a functional limitation, to the extent that functional limitations imply structure, they cannot be ignored. See, e.g., Textron Innovations Inc. v. Am. Eurocopter Corp., 498 F. App’x 23, 28 (Fed. Cir. 2012) (“In certain circumstances functional language may be used to add limitations to an apparatus claim.”) (citing K-2 Corp. v. Salomon S.A., 191 F.3d 1356, 1363 (Fed. Cir. 1999) (“[T]he functional language tells us something about the structural requirements . . . .”)). By its plain language, claim 3 requires a rotating unit that is structurally capable of “rotating] a dumpling wrapper cut by the cutting unit relative to a dumpling die,” such as the rotating unit described by the Appellants’ Specification. See, e.g., Spec. 10:5-11; Fig. 7.

In contesting the rejection, Appellant argues that although the claims “do not specify which passage communicates with the third outlet, . . . this is a matter of claim breadth rather than indefiniteness [and that the] breadth of a claim should not be equated with indefiniteness.”  Appeal Br. 7 (citing In re Miller, 441 F.2d  689, 693 (CCPA 1971)).

There is a “subtle distinction between a written description adequate to supports claim under § 112 and a written description sufficient to anticipate its subject matter under § 102(b).” Vas-Cath Inc. v. Mahurkar, 935 F.2d 1555, 1562 (Fed. Cir. 1991). To wit, “the description of a single embodiment of broadly claimed subject matter constitutes a description of the invention for anticipation purposes” even if “the same information in a specification might not alone be enough to provide a description of that invention for purposes of adequate disclosure.” Id. (quoting In re Lukach, 442 F.2d 967, 970 (CCPA 1971)).
