We are not persuaded by Appellants' argument that the Examiner has not shown preemption. Replay Br. 4. First, that the claims do not preempt all forms of the abstraction or may be limited to the abstract idea in the e-commerce setting do not make them any less abstract. See OIP Technologies, Inc. v. Amazon.com, Inc., 788 F.3d 1359, 1360—1361 (2015). Second, preemption is one test, but not the only test for finding a claim directed to an abstract idea. Third, as the claims do no more than lay out conceptual advice on one way to substitute credit accounts, and recite doing so by a general purpose computer, by definition of preemption this precludes all methods of following that advice. The recitation of a computer does not alter this analysis.

According to the Examiner, “the disclosure fails to describe a specific embodiment” of the concept “of relying only on the hose body itself to provide the biasing force that retracts the hose.”  Ans. 30.  As the Patent Owner points out, however, “that is not the correct standard for written description” and “‘[t]he relevant inquiry is whether a claim not limited to a [certain embodiment] is described.”  Reply Br. 3–5 (citing Anheuser-Busch Cos. v. Furthermore, Appellants correctly argue the Examiner’s reliance on routine optimization is improper. Modifications that would have been known to a person of ordinary skill are irrelevant to whether a reference anticipates a claim under 35 U.S.C. § 102. Titanium Metals Corp. v. Banner, 778 F.2d 775, 780 (Fed. Cir. 1985) (“[A]nticipation under § 102 can be found only when the reference discloses exactly what is claimed and that where there are differences between the reference disclosure and the claim, the rejection must be based on § 103 which takes differences into account.”) Still further, even under 35 U.S.C. § 103(a), the failure to provide sufficient evidence “that one skilled in the art would necessarily have appreciated the advantageous effects of providing a nitride insulating film in a semiconductor device within the claimed range” (App. Br. 13) renders a rejection based on obviousness improper.
