Appellants support this contention with a declaration from Appellant Makoto Souwa stating that “one [of] ordinary skill in the art would understand, a thermally sprayed layer would have a structure that closely matches the unevenness and crevices of the underlying layer.” Id. at 11 (citing Souwa Decl. dated April 7, 2014,17). Appellants, relying on In re Garnero, 412 F. 2d 276, 279 (CCPA 1979), then argue that the implied structural characteristics of a thermally sprayed layer should be considered in the patentability analysis of a product by process claim.
