The fact that Carlson's device during its normal use and operation may accidentally perform this method step is insufficient to support a finding that Carlson implicitly or inherently discloses moving the point of focus in the manner claimed. While an apparatus claim may be unpatentable over a prior device of like construction that is capable of performing the same function; it is otherwise with a method patent. The mere possession of an apparatus does not teach or suggest all the possible processes to which it may be adapted. See Carnegie Steel Co. v. Cambria Iron Co., 185 U.S. 403, 424--425 (1902).

1787 Ex Parte Schmidt et al 13140608 - (D) ROESEL 112(2)/103 112(2) Abel Law Group, LLP STACHEL, KENNETH J

Appellants emphasize that the term, "improving," appears in the preamble, but that alone is not a sufficient basis for concluding that the term is not a limitation of the claim. See Tom Tom, Inc. v. Michael Adolph, 790 F.3d 1315, 1323 (Fed. Cir. 2015) ("Whether to treat a preamble as a claim limitation is determined on the facts of each case in light of the claim as a whole and the invention described in the patent."). Appellants do not challenge the Examiner's determination that "improving" is a word of degree for which a standard must be provided in the Specification. See Seattle Box Company, Inc. v. Industrial Crating & Packing, Inc., 731 F .2d 818, 826 (Fed. Cir. 1984) ("When a word of degree is used the district court must determine whether the patent's specification provides some standard for measuring that degree.").

1765 Ex Parte Hedrick et al 12770529 - (D) OWENS 103 CANAANLAW, P.C. LENIHAN, JEFFREYS

For support, the Appellants rely on, inter alia, Kropa v. Robie, 187 F.2d 150, 152 (CCPA 1951). According to the Appellants:

In Kropa the Court held that the preamble, "an abrasive article," gave life and meaning to the interference count at issue, although the claim recited abrasive grains and a binder, because not every combination of those components forms an abrasive article .... Kropa supports patentability here, as not every combination of upper and lower sheets form "roll roofing."

App. Br. 12 (citation omitted).

We do not agree Appellants’ Specification defines the term “story arc” in a manner that conforms to the strict “words or expressions of manifest exclusion or restriction” requirement articulated by the Federal Circuit in Teleflex, Inc. v. Ficosa N. Am. Corp., 299 F.3d 1313, 1327 (Fed. Cir. 2002). Instead, the cited portion of the Specification uses non-limiting language to describe term “story arc.” We construe “story arc” in accordance with the extrinsic definition presented by Appellants, i.e., a subplot, underlying a plot, which moves a character or situation from one state to another throughout the story.

The admonition that "obvious to try" is not the standard under § 103 has been directed mainly at two kinds of error. In some cases, what would have been 'obvious to try' would have been to vary all parameters or try each of numerous possible choices until one possibly arrived at a successful result, where the prior art gave either no indication of which parameters were critical or no direction as to which of many possible choices is likely to be successful. In others, what was "obvious to try" was to explore a new technology or general approach that seemed to be a promising field of experimentation, where the prior art gave only general guidance as to the particular form of the claimed invention or how to achieve it.
