A claim that recites both a system (or apparatus) and a method of using that system (or apparatus) does not apprise one of ordinary skill in the art of its scope, and thus, is invalid under 35 U.S.C. 112, second paragraph. see IPXL Holdings, LLC v. Amazon.com, Inc., 430 F.3d 1377, 1384 (Fed. Cir. 2005). ...

Stated differently, one of ordinary skill in the art could reasonably consider the  "placed in an initial operating state" limitation as "directed to user actions, not system capabilities." In re Katz Interactive Call Processing Patent Litig., 639 F.3d 1303, 1318 (Fed. Cir. 2011), quoted in UltimatePointer, L.L.C. v. Nintendo Co., No. 2015-1297, 2016 WL 798354, at *9 (Fed. Cir. Mar. l , 2016). Thus, we reject claim I as invalid under 35 U.S.C. 112, second paragraph.

Specifically, these networking operations are not steps of a real-world economic practice or other similar abstract idea performed in a computer network. See, e.g., BuySafe, Inc. v. Google, Inc., 765 F.3d 1350, 1355 (Fed. Cir. 2014) (noting that the "claims [in that case] are squarely about creating a contractual relationship"—an abstract idea). Instead, the present claims expressly limit the settings to a subscriber to a network and requires processing these settings in a particular way to affect the network's service. It is a challenge particular to networking.

Because the claims are not drawn to any abstract idea recognized by the courts under Alice 's first step of the inquiry, we need not determine whether an inventive concept transforms the method into a patent-eligible application. Here, we only note that "the claimed solution is necessarily rooted in computer technology in order to overcome a problem specifically arising in the realm of computer networks." DDR Holdings, 773 F.3d at 1257, quoted in 2014 Interim Guidance, 79 Fed. Reg. at 74,632. Accordingly, claim I is eligible subject matter.

We declined to afford the claimed "identifier" patentable weight because  "[t]he critical question is whether there exists any new and unobvious functional relationship between the printed matter and the substrate." Mindrum 1 5 (quoting In re Gulack, 703 F.2d 1381, 1386 (Fed. Cir. 1983)). We answered that question in the negative, finding "[w]here the printed matter is not functionally related to the substrate, the printed matter will not distinguish the invention from the prior art in terms of patentability." In re Ngai, 367 F. 3d 1336, 1339 (Fed. Cir. 2004).
...
We recognize that the "[d]ifferences between an invention and the prior art cited against it cannot be ignored merely because those differences reside in the content of the printed matter." Gulack, 703 F.2d at 1385. The "critical question" is whether the claimed "identifier" is more than "a new instruction sheet" because it is claimed as a "machine-readable feature configured to provide automatic acquisition of information?" See Ngai, 367 F. 3d at 1338—39 (The Ngai court reasoned that if it "were to adopt Ngai's position, anyone could continue patenting a product indefinitely provided that they add a new instruction sheet to the product").

[T]his finding by the Examiner in the Answer is not supported by evidence of record.  "Where a reference is relied on to support a rejection, whether or not in a 'minor capacity,' there would appear to be no excuse for not positively including the reference in the statement of rejection." In re Hoch, 428 F.2d 1341, 1342 (CCPA 1970). Consequently, we cannot consider the teachings of the reference in this regard.

The test of obviousness is not whether an express suggestion of the claimed invention is present in any or all references but rather what the references taken collectively would have suggested to those of ordinary skill in the art presumed to be familiar with them. Although the Examiner is directed to give a claim term its broadest reasonable interpretation, the interpretation must be consistent with: (1) the ordinary and customary meaning of the term (unless the term has been given a special definition in the specification); (2) the use of the claim term in the specification and drawings; and (3) the interpretation that those skilled in the art would reach. See In re Cortright, 165 F.3d 1353, 1359 (Fed. Cir. 1999).
