Any special meaning assigned to a term "must be sufficiently clear in the specification that any departure from common usage would be so understood by a person of experience in the
field of the invention." Multiform Desiccants, Inc. v. Medzam, Ltd., 133 F.3d 1473, 1477 (Fed. Cir. 1998); see also Helmsderfer v. Bobrick Washroom Equip., Inc., 527 F.3d 1379, 1381 (Fed. Cir. 2008) ("A patentee may act as its own lexicographer and assign to a term a unique definition
that is different from its ordinary and customary meaning; however, a patentee must clearly express that intent in the written description."). Absent an express intent to impart a novel meaning to a claim term, the words take on the ordinary and customary meanings attributed to them by those of ordinary skill in the art. Brookhill-Wilk 1, LLC v. Intuitive Surgical, Inc., 334 F.3d 1294, 1298 (Fed. Cir. 2003) (citation omitted).

VENGLARIK FETSUGA, ROBERT M original LESTER, EVELYN A

The Patent Owner’s licensing of the claimed subject matter to its competitors is not meaningful evidence of non-obviousness. Our reviewing court instructs us that its “cases specifically require affirmative evidence of nexus where the evidence of commercial success presented is a license, because it is often ‘cheaper to take licenses than to defend infringement lawsuits.’” Iron Grip Barbell Co. v. USA Sports, Inc., 392 F.3d 1317, 1324 (Fed. Cir. 2004).

[R]eferences in a combination may be said to teach away where their combined teachings would produce a "seemingly inoperative device". See In re Sponnoble, 405 F.2d 578, 587 (CCPA 1969). What a reference teaches a person of ordinary skill is not "limited to what a reference specifically 'talks about' or what is specifically 'mentioned' or 'written' in the reference." Syntex (U.S.A.) LLC v. Apotex, Inc., 407 F.3d 1371, 1380 (Fed. Cir. 2005). In short, one skilled in the art is able to read a reference for all that it teaches and not limit a reference to its explicit text or a preferred embodiment. See Beckman Instruments, Inc. v. LKB  AB, 892 F.2d 1547, 1551 (Fed. Cir. 1989); see also In re Chapman, 357 F.2d 418, 424 (CCPA 1966) ("A reference can be used for all it realistically teaches, and is not limited to the disclosures in its specific illustrative examples.").
