Courts generally construe “configured to” more narrowly than “capable of.” See Sta–Rite Indus., LLC v. ITT Corp., 682 F.Supp.2d 738, 753 (E.D. Tex.2010) (construing “adapted to,” and “configured to,” as different from merely “having the capacity to”); see also Boston Scientific Corp. v. Cordis Corp., 2006 WL 3782840 (N.D. Cal. Dec. 20, 2006) (construing “adapted to,” in light of patent as a whole, to mean “configured to,” not “capable of”). Notwithstanding that courts, depending on the surrounding context, may sometimes construe “adapted to” in a broad sense to mean “capable of,” they, nevertheless, generally distinguish between structure that is “configured to” from structure that is merely “capable of.” Aspex Eyewear, 672 F.3d at 1349.
