With due respect, we believe the Examiner's ultimate conclusion of obviousness was based on hindsight as a result of a consideration of Sanyo's specification and not the prior art. In re McLaughlin, 58 CCPA 1310, 1313-14, 443 F.2d 1392, 1395 (CCPA 1971). The only evidence suggesting a "not less than 3.5" ratio is Sanyo's specification.

During examination, the PTO must interpret terms in a claim using "the broadest reasonable meaning of the words in their ordinary usage as they would be understood by one of ordinary skill in the art, taking into account whatever enlightenment by way of definitions or otherwise that may be afforded by the written description contained in the applicant’s specification." In re Morris, 127 F.3d 1048, 1054 (Fed. Cir. 1997).
Nevertheless, "courts must not ‘import[ ] limitations from the specification into the claim.’ . . . [I]t is improper to ‘confin[e] the claims to th[e] embodiments’ found in the specification . . . ."
