A reasonable expectation of success is a necessary part of a prima facie case of obviousness. In re Vaeck, 947 F.2d 488, 493 (Fed. Cir. 1991). "Both the suggestion [to combine references] and the reasonable expectation of success must be founded in the prior art, not in the applicant's disclosure." Id. Whether or not a person of ordinary skill in the art would have had a reasonable expectation that a particular combination of references would work is a pure question of fact. Alza Corp. v. Mylan Labs., Inc., 464 F.3d 1286, 1289 (Fed. Cir. 2006).

It is well established that the Examiner has the “burden of giving reasons, supported by the record as a whole, why the specification is not enabling…Showing that the disclosure entails undue experimentation is part of the PTO’s initial burden.” In re Angstadt, 537 F.2d 498, 504 (CCPA 1976). In determining whether any given disclosure would require undue experimentation to practice the claimed subject matter, the Examiner must consider not only the breadth of the claims, the amount of direction or guidance presented and the presence or absence of working examples, but also the nature of the invention, the state of the prior art, the relative skill of those in the art and the predictability or unpredictability of the art. In re Vaeck, 947 F.2d 488, 495 (Fed. Cir. 1991). When “a [S]pecification disclosure…contains a teaching of the manner and process of making and using the invention in terms which correspond in scope to those used in describing and defining the subject matter sought to be patented[,]” such [S]pecification disclosure “must be taken as in compliance with the enabling requirement of the first paragraph of § 112 unless there is reason to doubt the objective truth of the statements contained therein which must be relied on for enabling support.” In re Armbruster, 512 F.2d 676, 677 (CCPA 1975) (quoting In re Marzocchi, 439 F.2d 220 (CCPA 1971)).

The standard for determining whether the specification meets the enablement requirement was cast in the Supreme Court decision of Minerals Separation v. Hyde, 242 U.S. 261, 270 (1916) which postured the question: is the experimentation needed to practice the invention undue or unreasonable? That standard is still the one to be applied. In re Wands, 858 F.2d 731, 737 (Fed. Cir. 1988).

Determining enablement is a question of law based on underlying factual findings. In re Vaeck, 947 F.2d 488, 495 (Fed. Cir. 1991). The determination that “undue experimentation” would have been needed to make and use the claimed invention is not a single, simple factual determination. Rather, it is a conclusion that may be reached by weighing the following factual considerations: (1) the quantity of experimentation necessary, (2) the amount of direction or guidance presented, (3) the presence or absence of working examples, (4) the nature of the invention, (5) the state of the prior art, (6) the relative skill of those in the art, (7) the predictability or unpredictability of the art, and (8) the breadth of the claims. Wands at 737.

New Grounds of Rejection
Written Description: Claims 43, 47–65, and 67–69 are rejected under 35 U.S.C. § 112, first paragraph, as failing to comply with the written description requirement. ...

As correctly noted by the Examiner, independent claim 43 recites the open ended limitations of “greater than 430 W/cm” and “greater than 180 W/cm.” See Ans. 17. These limitations “do not meet the written description requirement because the phrase ‘at least’ ha[s] no upper limit and cause[s] the claim to read literally on [an] embodiment outside of” the disclosed range of values. In re Wertheim, 541 F.2d 257, 263 (CCPA 1976).

Appellants characterize their argument as being that Gysling and Small teach away from the proposed combination. (App. Br. 5.) The substance of Appellants’ argument, however, is directed to the question of whether a person of ordinary skill in the art would have had a reasonable expectation that the teachings of the two references could be combined successfully. Such an expectation is a necessary part of a prima facie case of obviousness. In re Vaeck, 947 F.2d 488, 493 (Fed. Cir. 1991).

Accordingly, it is “well settled that patent applicants are not required to disclose every species encompassed by their claims, even in an unpredictable art.” In re Vaeck, 947 F.2d 488, 496 (Fed. Cir. 1991).

For example, in Falkner v. Inglis, the court affirmed the conclusion of the Board of Patent Appeals and Interferences that claims to a modified pox virus vaccine were enabled, despite the fact that the specification focused on viruses other than pox virus, provided no examples directed to pox virus, and discussed pox virus only in general terms relating to the inventive disclosure. Falkner v. Inglis, 448 F.3d 1357, 1365 (Fed. Cir. 2006).

Falkner v. Inglis, 448 F.3d 1357, 79 USPQ2d 1001 (Fed. Cir. 2006) 2163

However, it is well settled that a claim does not lack enablement merely because it encompasses inoperative embodiments. See Atlas Powder Co. v. E.I. du Pont De Nemours & Co., 750 F.2d 1569, 1576 (Fed. Cir. 1984); see also In re Angstadt, 537 F.2d 498 (CCPA 1976).

A “recitation with respect to the manner in which a claimed apparatus is intended to be employed does not differentiate the claimed apparatus from a prior art apparatus” if the prior art apparatus teaches all the structural limitations of the claim.
