Appellant has provided persuasive argument and objective evidence of nonobviousness that outweighs the evidence of obviousness. Mintz v. Dietz & Watson, Inc., 679 F.3d 1372, 1379 (Fed. We are troubled by the ITC’s obviousness analysis. We have repeatedly held that evidence relating to all four Graham factors—including objective evidence of secondary considerations—must be considered before determining whether the claimed invention would have been obvious to one of skill in the art at the time of invention. Transocean Offshore Deepwater Drilling, Inc. v. Maersk Drilling USA, Inc., 699 F.3d 1340, 1349 (Fed. Cir. 2012); see also Mintz v. Dietz & Watson, Inc., 679 F.3d 1372, 1379 (Fed. An examiner’s reasoning “may include recourse to logic, judgment, and common sense available to the person of ordinary skill,” which does “not necessarily require explication in any reference or expert opinion.” See Perfect Web Techs., Inc. v. InfoUSA, Inc., 587 F.3d 1324, 1328-29 (Fed. Cir. 2009); In re Bozek, 416 F.2d 1385, 1390 (CCPA 1969) (examiner may rely on “common knowledge and common sense of the person of ordinary skill in the art without any specific hint or suggestion in a particular reference”). However, “the mere recitation of the words ‘common sense’ without any support adds nothing to the obviousness equation.” Mintz v. Dietz & Watson, Inc., 679 F.3d 1372, 1377 (Fed. Cir. 2012).

We have not altered the thrust of the rejection so as to deprive Appellants a fair opportunity to respond. Request at 3 citing In re Leithem, 661 F .3d 1316,1319, 100 USPQ 2d 1155, 115 8 (Fed. Cir. 2011 ). Rather, we have merely relied upon a reference akin to a technical dictionary to confirm the meaning of terms used in the references before us...

Finally, Appellants contend we overlooked objective indicia of nonobviousness. Request 7-8. The record does not actually contain any objective indicia of nonobviousness like that discussed in Mintz v. Dietz and Watson (Fed. Cir. No. 2010-1341, May 30, 2012) (cited by Appellants).

The mere recitation of the words “common sense” without any support adds nothing to the obviousness equation. Within the statutory test to determine if a claimed invention has advanced its technical art field enough to warrant an exclusive right, “common sense” is a shorthand label for knowledge so basic that it certainly lies within the skill set of an ordinary artisan.
