A claim can be obvious even where all of the claimed features are not found in specific prior art references, where “there is a showing of a suggestion or motivation to modify the teachings of [the prior art] to the claimed invention.” SIBIA Neurosciences, Inc. v. Cadus Pharm. Corp., 225 F.3d 1349,1356 (Fed. Cir. 2000) (concluding that patent would have been obvious in light of teachings in prior art which provided motivation and suggestion to modify existing techniques to arrive at method in question).
Ormco Corp. v. Align Tech., Inc., 463 F.3d 1299, 1307 (Fed. Cir. 2006).
However, “[e]ven when obviousness is based on a single prior art reference, there must be a showing of a suggestion or motivation to modify the teachings of that reference.” In re Kotzab, 217 F.3d 1365, 1370 (Fed. Cir. 2000).

The principle of "rearrangement of the parts" finds its roots in In re Japikse, 181 F.2d 1019, 1023 (CCPA 1950). There, claims were held unpatentable because rearranging the position of a starting switch would not have modified the operation of the device. Id. But, Japikse does not stand for a per se rule of obviousness simply through rearrangement of individual parts nor does it displace the requirement of an articulated reason to support the proposed modification. See In re Fritch, 972 F.2d 1260, 1266 (Fed. Cir. 1992).

The principle of "rearrangement of the parts" finds its roots in In re Japikse, 181 F.2d 1019, 1023 (CCPA 1950). There, claims were held unpatentable because rearranging the position of a starting switch would not have modified the operation of the device. Id. But, Japikse does not stand for a per se rule of obviousness simply through rearrangement of individual parts nor does it displace the requirement of an articulated reason to support the proposed modification.
