Moreover, we conclude, under a broad but reasonable interpretation, the preamble of claim 12 merely recites an intended use of the "apparatus" that is without support in the body of the claim:
12. An apparatus operable pursuant to IEEE 802.11 standard, comprisng:
a dynamic frequency selection message generator configured to generate a dynamic frequency selection message, the dynamic frequency selection message indicating a change of frequency allocations upon which to communicate the data, the change made to attain a selected statistical spreading." 6
(Claim 12, (emphasis added)).
We are not persuaded the Examiner erred because the body of claim 12 is silent regarding the IEEE 802.11 standard recited in the preamble.
6 Contra Eaton Corp. v. Rockwell Int 'l Corp., 323 F.3d 1332, 1339 (Fed. Cir. 2003) (citing e.g., Electro Sci. Indus. v. Dynamic Details, Inc., 307 F.3d 1343, 1348 (Fed. Cir. 2002)) ("When limitations in the body of the claim rely upon and derive antecedent basis from the preamble, then the preamble may act as a necessary component of the claimed invention").
