Appellant’s second argument is “there is no reason to modify . . . Bland to provide the asserted first part 56 to be for driving a drop in anchor.”  Appeal Br. 7; Reply Br. 3.  We disagree.  In this regard the Examiner cites In re Einstein, 46 F.2d 373 (CCPA 1931), which sustained the Office’s determination of obviousness on the basis that “a mere reversal of the essential working parts of a previously patented device did not constitute invention.”  Id. at 374.  Appellant does not identify any reason why this obviousness rationale may be deficient, or cite to any evidence in rebuttal of the Examiner’s reason for modifying Bland.

Citing In re Einstein, 46 F.2d 373, 8 USPQ 166 (CCPA 1931), the Examiner concludes that it would have been obvious to reverse the location of the bumps with the location of the grooves, “since it has been held that a mere reversal of the essential working parts of a device involves only routine skill in the art” (Ans. 5).

The Examiner’s sole reliance on the precedent in Einstein as a factual basis for concluding that the subject matter of claim 1 would have been obvious is improper because precedent cannot establish facts. See, e.g., Case v. CPC Int’l, Inc., 730 F.2d 745, 750 (Fed. Cir. 1984).

The Examiner goes on to say that the airflow of Nakumura could be reversed to flow from the extension device to the computer. Ans. 10, citing In re Einstein, 46 F.2d 373 (CCPA 1931)...

In re Einstein stands for the proposition that "a mere reversal of the essential working parts of a previously patented device" does not constitute invention.  In re Einstein, 26 F.2d 374 (emphasis added).  however, the Examiner's proposed reversal is not a "mere reversal of essential working parts" but rather a reversal of an entire air flow entailing parts outside of the cited air flow path.

We now hold that evidence of an accused inducer’s good-faith belief of invalidity may negate the requisite intent for induced infringement.1 This is, of course, not to say that such evidence precludes a finding of induced infringement. Rather, it is evidence that should be considered by the fact-finder in determining whether an accused party knew “that the induced acts constitute patent infringement.” Global-Tech, 131 S. Ct. at 2068.

1 In dissent, Judge Newman does little more than construct a straw man and set him ablaze. We certainly do not hold “that if the inducer of infringement believes in good faith that the patent is invalid, there can be no liability for induced infringement.” J. Newman Op. concurring-in-part, dissenting-in-part 1. Nor do we “include a belief in patent validity as a criterion of infringement.” Id. at 4.
