To be sure, original claims are part of the Specification, and, in many cases, will satisfy the written description requirement. Crown Packaging Tech., Inc. v. Ball Metal Beverage Container Corp., 635 F.3d 1373, 1380 (Fed. Cir. 2011) (citing Ariad, 598 F.3d at 1349). But here, while original independent claims 21, 27, and 33 recited, in pertinent part, tracking actual payments of royalties paid by licensees according to respective schedules in the license agreement, the original claims did not recite the particular comparison and notification steps as now claimed. That original claims 21, 27, and 33 were later amended on March 18, 2013 to add these specific steps is telling in this regard.

Ariad Pharms., Inc. v. Eli Lilly & Co., 598 F.3d 1336, 94 USPQ2d 1161 (Fed. Cir. 2010)(en banc)   2161 ,   2161.01 ,   2163 ,   2163.03 ,   2173.05(g) ,   2181

The Examiner has rather speculated that, inherently, a nominal amount of such compressive force is exerted by gravity and the waterproof bond. Such a speculation is erred, particularly insofar as failing to establish a reason to believe that gravity or bonding compressively holds the transducer 132 with greater than de minimis force. See Crown Packaging Technology, Inc. v. Ball Metal Beverage Container Corp., 635 F.3d 1373, 1383 (Fed. Cir. 2011) (“[I]nherent anticipation requires . . . more than the presence of an unrecognized de minimis quantity of claimed substance in the prior art[.]” (citations omitted)).

The Federal Circuit has outlined how the prima facie case burden for anticipation is met, and its purpose. Specifically, “the prima facie case is merely a procedural device that enables an appropriate shift of the burden of production.” Hyatt v. Dudas, 492 F.3d 1365, 1369 (Fed. Cir. 2007). This burden is met by “adequately explain[ing] the shortcomings it perceives so that the applicant is properly notified and able to respond.” Id, at 1370. It is only “when a rejection is so uninformative that it prevents the applicant from recognizing and seeking to counter the grounds for rejection” that the prima facie burden has not been met and the rejection violates the minimal requirements of 35 U.S.C. §132. Chester v. Miller, 906 F.2d 1574, 1578 (Fed. Cir. 1990).

Construing means-plusfunction claim language in accordance with 35 U.S.C. § 112, paragraph 6, is a two-step process.

The first step in construing a means-plus-function claim limitation is to define the particular function of the claim limitation. Budde v. Harley-Davidson, Inc., 250 F.3d 1369, 1376 (Fed.Cir.2001). “The court must construe the function of a means-plus function limitation to include the limitations contained in the claim language, and only those limitations.” Cardiac Pacemakers, Inc. v. St. Jude Med., Inc., 296 F.3d 1106, 1113 (Fed.Cir.2002). . . . The next step in construing a means-plus-function claim limitation is to look to the specification and identify the corresponding structure for that function. “Under this second step, ‘structure disclosed in the specification is “corresponding” structure only if the spe
cification or prosecution history clearly links or associates that structure to the function recited in the claim.’ ” Med. Instrumentation & Diagnostics Corp. v. Elekta AB, 344 F.3d 1205, 1210 (Fed.Cir.2003) (quoting B. Braun Med. Inc. v. Abbott Labs., 124 F.3d 1419, 1424 (Fed.Cir.1997)).

Golight Inc. v. Wal-Mart Stores Inc., 355 F.3d 1327, 1333-34 (Fed. Cir. 2004).
