In anticipation, “the Board must compare the construed claim to a prior art reference and make factual findings that ‘each and every limitation is found either expressly or inherently in [that] single prior art reference.’” In re Crish, 393 F.3d 1253, 1256 (Fed. Cir. 2004). In case of doubt as to whether claims of an application are anticipated, the scales should be inclined toward the applicant. See In re Coley, 40 F.2d 982, 986 (CCPA 1930) (“Where there is such doubt, the scales should be inclined toward the applicant.”).

Under these circumstances, the Federal Circuit's holding in In re Crish is instructive. 393 F.3d 1253, 1257 (Fed. Cir. 2004). In Crish, the Court held that the claimed oligonucleotide was not limited to a particular portion of numbered nucleotides notwithstanding that such "portion" was preceded with the transitional phrase "consists of." (Id.) The Court affirmed the PTO' s construction that the claims were broader and could include other nucleotides, including other portions of a broader sequence, because the claims also used the open-ended transition "comprising." (Id. at 1256 (affirming the Board's determination "that the transition language 'comprising' allowed the claims to cover the entire involucrin gene plus other portions of the plasmid, as long as the gene contained the specific portions of SEQ ID NO: 1 recited by the claim.")

The Federal Circuit rejected Crish’s proposed narrow construction of the claim on appeal seeking to limit the claim to nucleotides 521 to 2473 noting the presence of the transition term “comprising” and observing that the “at least a portion” language “implies that the pending claims contemplate additional nucleotides.” 393 F.3d at 1257. The “consists” was held to limit only the “portion”. As a result, the claim on appeal could include other nucleotides and was held to be unpatentable over the prior art. 

More relevant to the facts in this appeal are (1) Berenter v. Quigg, 737 F. Supp. 5 (D.D.C. 1988) (step (a) of a claim calling for a process comprising steps (a) through (d), where step (a) was defined by “consisting of”, did not include other (a)-like steps) and (2) Mannesmann Demag Corp. v. Engineered Metal Prods. Co., Inc., 793 F.2d 1279, 1282 (Fed. Cir. 1986) (element (a) of a claim calling for a combination of elements comprising elements (a) through (d), where element (a) was defined by “consisting of”, did not include other (a)-like elements).
