As an initial matter, we note that an Examiner's burden of proving unpatentability when rejecting claims in a patent application is by a preponderance of the evidence. In re Caveney, 761 F.2d 671, 674 (Fed. Cir. 1985). In order to satisfy this standard, the evidence must demonstrate that it is more likely than not that the alleged facts are actually true. See Bosies v. Benedict, 27 F.3d 539, 542 (Fed. Cir. 1994) (noting that the preponderance of the evidence standard "only requires the fact finder 'to believe that the existence of a fact is more probable than its nonexistence"' (quoting In re Winship, 397 U.S. 358, 371 (1970)).

An Examiner’s factual finding regarding what a reference discloses must be supported by a preponderance of the evidence. See In re Caveney, 761 F.2d 671, 674 (Fed. Cir. 1985) (“preponderance of the evidence is the standard that must be met by the PTO in making rejections”). In order to satisfy this standard, the evidence must demonstrate that it is more likely than not that the alleged facts are actually true. See Bosies v. Benedict, 27 F.3d 539, 542 (Fed. Cir. 1994) (the preponderance of the evidence standard requires the finder of fact to believe that the existence of a fact is more probable than its nonexistence).

A drawing or illustration “can be cited against the claims of a utility patent application even though the feature shown in the drawing was unintended or unexplained.” In re Aslanian, 590 F.2d 911, 914 (CCPA 1979). However, like all references, a drawing or illustration is evaluated and applied on the basis of what it reasonably discloses and suggests to a person having ordinary skill in the relevant technology. In re Baum, 374 F.2d 1004, 1009 (CCPA 1967). An Examiner’s factual finding regarding what any reference discloses must be supported by a preponderance of the evidence. In re Caveney, 761 F.2d 671, 674 (Fed. Cir. 1985) (“preponderance of the evidence is the standard that must be met by the PTO in making rejections”). A preponderance of the evidence is evidence that is more convincing than the opposing evidence. See, C. McCormick, McCormick on Evidence § 339 (2d ed. 1972) ("[E]vidence preponderates when it is more convincing to the trier than the opposing evidence." McCormick, supra, at 793).

Under such circumstances, we are persuaded by Appellants of error in the Examiner’s rejections for lacking sufficient motivation to combine. After evidence or argument is submitted by the applicant in response
to the Examiner’s case, patentability is determined on the totality of the record, by a preponderance of evidence with due consideration to persuasiveness of argument. In re Spada, 911 F.2d 705, 707 n.3 (Fed. Cir. 1990); In re Corkill, 771 F.2d 1496, 1500 (Fed. Cir. 1985); In re Caveny, 761 F.2d 671, 674 (Fed. Cir. 1985); In re Johnson, 747 F.2d 1456, 1460 (Fed. Cir. 1984).

An examiner's burden of proving unpatentability when rejecting claims in a patent application is by a preponderance of the evidence. In re Caveney, 761 F.2d 671, 674 (Fed. Cir. 1985). In order to satisfy this standard, the evidence must demonstrate that it is more likely than not that the alleged facts are actually true. See Bosies v. Benedict, 27 F.3d 539, 541-42 (Fed. Cir. 1994) (the preponderance of the evidence standard requires the finder of fact to believe that the existence of a fact is more probable than its nonexistence).
