Claim 1 is directed to an apparatus. As such, the limitations in claim 1 directed to the operating conditions within the apparatus are only meaningful to the extent they serve to differentiate the claimed apparatus structure from the prior art apparatus structure. Duryee, 68 U.S. 531, 570 (1863) ("A machine is a concrete thing, consisting of parts, or of certain devices and combination of devices."); In re Gardiner, 171 F.2d 313, 315-16 ( CCP A 1948) ("It is trite to state that the patentability of apparatus claims must be shown in the structure claimed and not merely upon a use, function, or result thereof."); In re Casey, 370 F.2d 576, 580 (CCPA 1967) ("The claims in issue call for an apparatus or machine, viz. a tape dispensing machine. Independent claim 1 is indefinite because the claim recites both an apparatus and a method step of using the apparatus. See IPXL Holdings, L.L.C. v. Amazon.com, Inc., 430 F.3d 1377, 1384 (Fed. Cir. 2005) (a single claim reciting "both an apparatus and the method steps of using the apparatus is indefinite under 35 U.S.C. [§] 112, second paragraph"); cf MasterMine Software, Inc. v. Microsoft Corp., 874 F.3d 1307, 1316 (Fed. Cir. 2017) (a claim reciting both an apparatus and a method step is not indefinite when the "claim[] ... do[ es] not claim activities performed by the user"). Here, Appellant's claim 1 is indefinite because the claim recites an apparatus and a method of using the device, such that "it is unclear whether infringement ... occurs when one creates [the device] ... or ... when the user actually uses [the device]." Claim 10 is directed to a driver, a machine or apparatus. As correctly pointed out by the Examiner, "the manner in which a device is intended to be employed does not differentiate the claimed apparatus from prior art apparatus satisfying the claimed structural limitations," and "apparatus claims must be structurally distinguishable from the prior art." Ans. 3. This is because "[a] machine is a concrete thing, consisting of parts, or of certain devices and combination of devices." See Burr v. Duryee, 68 U.S. 531, 570 (1863) (defining "machine"). Because an apparatus is a structure, the apparatus must be distinguished from the prior art on the basis of structure, and where there is reason to believe that the structure of the prior art is inherently capable of performing the claimed function, the burden shifts to the applicant to show that the claimed fünction patentably distinguishes the claimed structure from the prior art structure. See In re Schreiber, 128 F.3d 1473, 1478 (Fed. Cir. 1997); In re Hallman, 655 F.2d 212, 215 (CCPA 1981).

As noted supra, Section 101 of the Patent Act permits the patenting of “any new and useful process, machine, manufacture, or composition of matter.” 35 U.S.C. § 101. Our reviewing Court has found:

For all categories except process claims, the eligible subject matter must exist in some physical or tangible form. To qualify as a machine under section 101, the claimed invention must be a “concrete thing, consisting of parts, or of certain devices and combination of devices.” Burr v. Duryee, 68 U.S. 531, 570 . . . (1863). To qualify as a manufacture, the invention must be a tangible article that is given a new form, quality, property, or combination through man-made or artificial means. Diamond v. Chakrabarty, 447 U.S. 303, 308 . . . (1980). Likewise, a composition of matter requires the combination of two or more substances and includes all composite articles. Id.

We find claims 7–11 to be patent-ineligible because they are not directed to anything that exists in a physical or tangible form.

Consequently, we reject claims 7–11 under 35 U.S.C. § 101 for failing to recite a statutory category of patent-eligible subject matter. See, Digitech Image Tech. 758 F.3d at 1349–1350 (finding claims directed to a device profile consisting of a collection of information invalid under 35 U.S.C. § 101 for falling outside of any statutory category of patent-eligible subject matter).
