In addition, the claims here are drawn to a product-by-process format. “[I]f an inventor invents a product whose structure is either not fully known or too complex to analyze . . . this court clarifies that the inventor is absolutely free to use process steps to define this product. The patent will issue subject to the ordinary requirements of patentability. The inventor will not be denied protection. Because the inventor chose to claim the product in terms of its process, however, that definition also governs the enforcement of the bounds of the patent right.” Abbott Labs. v. Sandoz, Inc., 566 F.3d 1282, 1294 (Fed. Cir. 2009) (en banc). And “nesting of the product-by-process limitation within a method of treatment claim does not change the proper construction of the product-by-process limitation itself.” Biogen v. EMD Serono, 976 F.3d 1326, 1334 (Fed. Cir. 2020). ...

This type of product-by-process limitation has been “developed in response to the need to enable an applicant to claim an otherwise patentable product that resists definition by other than the process by which it is made.” In re Thorpe, 777 F.2d 695, 697 (Fed. Cir. 1985).

However, “the patentability of a claim to a product does not rest merely on a difference in the method by which that product is made.” In re Pilkington, 411 F.2d 1345, 1348 (CCPA 1969). The product-by-process limitation of claim 1 therefore requires orally administering an antibody preparation that is structurally the same as one produced by the recited method.
