Appellant argues that "[i]f a description or the enabling disclosure of a specification is not commensurate in scope with the subject matter encompassed by a claim," then "that fact alone" does not render the claim indefinite. App. Br. 11, citing In re Borkowski, 422 F.2d 904, 909 (CCPA 1970). We agree with Appellant, as here the language of the claim is not indefinite. The Examiner identifies a problem in what the Specification teaches, which is separate from whether the claim is indefinite.

In Japikse the court summarized the Patent Office position regarding shifting a switch having no effect on the operation of the claimed devices, and stated, without further discussion, "[w]e find no error in the holding." Although MPEP § 2144.04(IV)(C) cites Japikse as an example of using legal rationale as the basis for concluding that a rearrangement of parts was obvious, that same section of the MPEP also cautions (citing Ex parte Chicago Rawhide Mfg. Co., 223 USPQ 351, 353 (BPAI 1984)):
[t]he mere fact that a worker in the art could rearrange the parts of the reference device to meet the terms of the claims on appeal is not by itself sufficient to support a finding of obviousness. The prior art must provide a motivation or reason for the worker in the art, without the benefit of appellant's specification, to make the necessary changes in the reference device.

The mere fact that McGuire teaches a PPU that can perform parallel/concurrent processing of threads and programs does not mean that applying such concurrent processing to any two particular elements would have been obvious. As Judge Learned Hand long ago explained, simply finding prior art disclosures of the claimed elements is insufficient:
[a]ll machines are made up of the same elements; rods, pawls, pitmans, journals, toggles, gears, cams, and the like, all acting their parts as they always do and always must. All compositions are made of the same substances, retaining their fixed chemical properties. But the elements are capable of an infinity of permutations, and the selection of that group which proves serviceable to a given need may require a high degree of originality. It is that act of selection which is the invention ....
