“[A]n inventive concept can be found in the non-conventional and non generic arrangement of known, conventional pieces,” even if these pieces constitute generic computer-related components. Bascom Global Internet v. AT&T Mobility LLC , 827 F.3d 1341, 1350 (Fed. Cir. 2016). The instant claims are similar to those in Bascom in that as in Bascom, an intermediary is inserted between two otherwise conventional computer nodes to move the location where a process is otherwise ordinarily executed. In Bascom it was filtering and in the instant claims it is checking on credit use limitations. The reasons for moving are similar in both cases and are rooted in the ways of internet technology.

The use of “i.e.,” in the intrinsic record is often definitional. Edwards Lifesciences LLC v. Cook Inc., 582 F.3d 1322, 1334 (Fed. Cir. 2009) (“[U]se of ‘i.e.’ signals an intent to define the word to which it refers.”); see also Abbott Labs. v. Novopharm Ltd., 323 F.3d 1324, 1330 (Fed. Cir. 2003) (holding that a patentee “explicitly defined” a term by using “i.e.” followed by an explanatory phrase). Here, in describing the difference between detecting a primary stream for single or dual stream transmissions, the Specification provides that for the dual stream transmission, an extra term is utilized and “[t]his extra term is due to the inter-stream interference, i.e., Si [the primary stream] and S2 [the secondary stream] will interfere with each other.” Spec. 11:13—20. As such, the broadest reasonable interpretation of “inter-stream interference,” consistent with the Specification, is the interference caused by the transmission of one stream on another concurrently transmitted stream.

Appellants first contend that one of ordinary skill in the art would understand that a thermally sprayed layer has a specific implied structure. Appeal Br. 10. Appellants support this contention with a declaration from Appellant Makoto Souwa stating that “one [of] ordinary skill in the art would understand, a thermally sprayed layer would have a structure that closely matches the unevenness and crevices of the underlying layer.” Id. at 11 (citing Souwa Decl. dated April 7, 2014,17). Appellants, relying on In re Garnero, 412 F. 2d 276, 279 (CCPA 1979), then argue that the implied structural characteristics of a thermally sprayed layer should be considered in the patentability analysis of a product by process claim.

Appellants do not point to any distinction between the structure set forth in claim 1 and that of Hibner. A recitation with respect to the manner in which a claimed apparatus is intended to be employed, as is the limitation “wherein actuation of the motor drive assembly causes the inner tube to rotate at a speed of at least about 3000 rotations per minute, and to oscillate translationally at a rate of about 1.5 to about 4 cycles per second,” does not differentiate the claimed apparatus from a prior art apparatus satisfying the structural limitations claimed.
