Contrary to the Patent Owner's argument, the Federal Circuit has held that "[i]f accessibility is proved, there is no requirement to show that particular members of the public actually received the information." Constant v. Advanced Micro-Devices, Inc., 848 F.2d 1560, 1569 (Fed. Cir. 1988). In applying this rule, the Federal Circuit held that, in a similar situation, a product manual bearing an inscription dating the manual to May 1996, where a declarant stated that it was publicly available to customers, was prior art "[i]n view of the Manual's inscription date, the Smaha Declaration, and evidence of NetStalker advertisements published in 1995."
