Examiner correctly asserts that “it is not inventive to discover the optimum or workable ranges by routine experimentation” In re Aller, 220 F.2d 454, 456 (CCPA 1955). This is, however, true “where the general conditions of a claim are disclosed in the prior art.” Id. On this record, Examiner failed to establish an evidentiary basis, or articulate a rationale, that supports a conclusion that a person of ordinary skill in this art would have considered that a side wall thickness of between approximately 2 mm and 5 mm would have been the optimum or workable range for the shell material suggested by the combination of Herrenbruck and Kopelle (see App. Br. 4 (“Examiner has merely concluded that it would have been obvious to one having ordinary skill in the art at the time the invention was made to have made the shell as claimed”); Cf. We do not find Requester’s expert opinion persuasive. Neither the Examiner nor the Board is bound by statements of an expert in an affidavit, but rather, such evidence should be evaluated and considered for its
probative value, like all other evidence in the record. See Velander v. Garner, 348 F.3d 1359, 1371 (Fed. Cir. 2003) ("It is within the discretion of the trier of fact to give each item of evidence such weight as it feels
appropriate . . . In giving more weight to prior publications than to subsequent conclusory statements by experts, the Board acted well within that discretion"); citing Ashland Oil, Inc. v. Delta Resins & Refractories, Inc., 776 F.2d 281, 294 (Fed.Cir.1985) ("Lack of factual support for expert opinion going to factual determinations, however, may render the testimony of little probative value in a validity determination."). In addition, statements do not become facts merely because they are set forth in declarations. Rather, the statements must be weighed based on their probative value and other objective evidence submitted in support thereof, if any. See Velander, 348 F.3d at 1371; Ashland Oil, 776 F.2d at 294.

Recently, the Federal Circuit held that a newsgroup post was a printed publication under § 102. Suffolk Techs., LLC v. AOL Inc., No. 2013-1392, 2014 WL 2179274, at *5-6 (Fed. Cir. May 27, 2014). In Suffolk, while there was no evidence in the record that any person of ordinary skill (other than the post’s author) had actually accessed the specific newsgroup on which the alleged prior art was posted, the court was persuaded by evidence that persons of ordinary skill used newsgroups generally at that time. Id. at *5. The court also held that the reference was sufficiently disseminated because the newsgroup was organized by subject matter (so a person interested in the topic could find the post at issue and others like it), the newsgroup’s purpose was to facilitate discussion of information in its posts, and several users had in fact accessed and responded to the post. Id.

In contrast, the Federal Circuit vacated a summary judgment of invalidity based on a paper posted on an FTP server where the record appeared to show the paper was not a printed publication under § 102. SRI Int’l, Inc. v. Internet Sec. Sys., Inc., 511 F.3d 1186, 1196-97 (Fed. Cir. 2008). In SRI Int’l, the public was not notified of the paper’s existence, and the nature of the FTP server did not inform interested artisans that the paper or like information was present on the server. Id. Therefore, the court held the record did not support the summary judgment ruling that the paper was accessible by the public. Id.
