1777 Ex Parte Paillard et al 12424225 - (D) NAGUMO 103 COATS & BENNETT, PLLC GIONTA FITZSIMMON, ALLISON

The Examiner’s attempt to shift the burden of proof regarding the obviousness of these limitations to Paillard fails for lack of the required evidentiary foundation. It is not enough to establish that a person having ordinary skill in the art would have considered the claimed invention chemically and physically reasonable: few inventions are not.

See, e.g., In re Crish, 393 F.3d 1253, 1259 (Fed. Cir. 2004) (“[W]hen the prior art evidence reasonably allows the PTO to conclude that a claimed feature is present in the prior art, the evidence ‘compels such a conclusion if the applicant produces no evidence or argument to rebut it.’” (quoting In re Spada, 911 F.2d 705, 708 n.3 (Fed. Cir. 1990)) and In re Best, 562 F.2d 1252, 1255, 195 USPQ 430, 433 (CCPA 1977) (“Where . . . the claimed and prior art products are identical or substantially identical, or are produced by identical or substantially identical processes, the PTO can require an applicant to prove that the prior art products do not necessarily or inherently possess the characteristics of his claimed product.”)

Conversely, a prior art structure does not satisfy a functional limitation in an apparatus claim unless the structure is shown, under the applicable burdens of proof and production, to be capable of performing the recited function. This is true even if the structure might have been modified (e.g., programmed) to perform the recited function. Typhoon Touch Tech., Inc. v. Dell, Inc., 659 F.3d 1376, 1380-81 (Fed. Cir. 2011).

It appears that Appellants consider claim 18 to be a dependent claim which depends from claim 1 (id.). This is not correct.

Claim 18 is directed to "[a] data storage unit for a system according to claim 1" wherein the recitation "for a system according to claim 1" merely describes the intended use of the claimed data storage unit. This intended use recitation does not cause claim 18 to be a dependent claim which includes all the claim 1 limitations and further limits claim 1 in accordance with 37 C.F.R. § 1.75(c). See also Ex parte Gillis, No. 2011-007483, 2013 WL 860588 at *2-*4 (PTAB March 4, 2013) ("[C]laims that refer to other claims are not necessarily dependent claims. . . . [T] the statute does not say that a dependent claim is one that contains a reference to another claim, merely that a dependent claim shall have a reference to another claim."). The only subject matter defined and required by claim 18 is the data storage unit by itself which on this record is indisputably taught by each of the applied references.

Further, we note that the product washed constitutes the material on which the flume washer performs work and, thus, does not confer a patentable limitation on the claimed flume washer. See, e.g., In re Otto, 312 F.2d 937, 939-40 (CCPA 1963); In re Rishoi, 197 F.2d 342, 344-45 (CCPA 1952) (“[T]here is no patentable combination between a device and the material upon which it works.”); In re Young, 75 F.2d 996 (CCPA 1935); In re Smith, 36 F.2d 302, 303 (CCPA 1929) (“It might be argued that the invention here consists in a combination of extra length carbons with the old machine, and that such a combination is patentable. It will be borne in mind that it has been long established that a person may not patent a combination of device and material upon which the device works, nor limit other persons from the use of similar material by claiming a device patent.”).
